Yiwu

SHANGHAI (THE BENELUX CHAMBER OF COMMERCE) - In order to promote production and reduce counterfeight and trademark infringement, Flanders Investment & Trade, the Benelux Chamber of Commerce in Shanghai and DaWo Law Firm embarked on a joint trip to Yiwu, Zhejiang Province. The goal of this envoy was to learn more on measures taken by Yiwu's Market Regulation Authority (AMR) to battle counterfeit productions and thus creating a safe and sustainable environment for Benelux businesses to produce goods.


Yiwu, China's capital of International Trade

Yiwu is located in central Zhejiang Province, the Eastern edge of the Jinqu Basin and has a city area of 1105 km2. Yiwu holds a household population of more than 890,000 and a resident population of nearly 1.9 million. Yiwu has a long history and was founded in 222 B.C. The county was known as Wu wound in ancient times and was named after Yan Wu.


The Yiwu market, spanning over 6.4 million square meters with 75,000 business spaces, is renowned as the world's largest wholesale market for small commodities. It offers an impressive variety of over 2.1 million products across 26 major categories. Notably, it has established industry standards like the "Market Credit Index" and "Small Commodity Classification and Code." Yiwu excels in online and offline integration, with robust e-commerce growth and top rankings in domestic and foreign online businesses, express business volume, and cross-border e-commerce. Yiwu's international prominence is evident through its platforms like "Yiwu China Import Commodity City," attracting global trade and investment, and offering comprehensive open functional platforms and foreign-related management services.

What does the AMR do?

The Yiwu Municipal Market Supervision Administration has an administrative enforcement team and has 15 offices (branch offices) to receive and handle cases of various types of violations in the field of market supervision, including cases of infringement of intellectual property rights (IP).

In the work of combating intellectual property infringement and counterfeit products, Yiwu Market Supervision Bureau adheres to the concept of "big hit, big prosperity, small hit, small prosperity, no hit, no prosperity", and strictly fights and investigates infringement and counterfeit violations, firmly guarding Yiwu's excellent business environment.


First and foremost, they uphold the banner above and take strict measures by implementing comprehensive law enforcement actions under the "Yijing" campaign, with a focus on intellectual property rights enforcement in import and export trade. 


Currently, the Yiwu Market Supervision Bureau handles over 2,700 cases annually, with a significant number of them related to intellectual property rights. Each year, their bureau transfers around 60 cases suspected of criminal offenses, including those involving intellectual property rights, to the public security authorities for further investigation. The Yiwu Market Supervision Bureau is the only market supervision department in the province exercising copyright enforcement powers. 


Due to its rigorous crackdown on copyright infringement, it has been recognized as an outstanding unit in the national efforts against copyright infringement and piracy for seven consecutive years and was selected for the 2020 "China Copyright Gold Award" management prize.


Secondly, they aim to deepen collaborative protection and achieve "full coordination": every year, they organize joint meetings with public security, customs, and other relevant departments to exchange information and discuss efforts to combat intellectual property infringement and counterfeit products. They establish law enforcement cooperation mechanisms with the police, customs, procuratorate, and judiciary, enabling the sharing of intelligence information to effectively eliminate gaps and risks in law enforcement. 


In 1995, the city established the first National Association for Protecting well-known Brands. This association serves as a bridge between enterprises and law enforcement agencies, providing a smooth channel for complaints and creating an efficient, convenient, and precise anti-counterfeiting and rights protection framework. To date, the association has included 136 local companies and national intellectual property protection organizations, representing 223 well-known brands both domestically and internationally. It plays a crucial role in collecting case clues and authenticating product authenticity. These are the relevant aspects of our work on intellectual property rights.
